INEC MUST OBEY SUPREME COURT JUDGMENT – ADEYANJU

Human rights lawyer and political commentator, Deji Adeyanju, don call on the Independent National Electoral Commission, INEC, to immediately comply with the recent Supreme Court judgment on the Electoral Act 2026.

Adeyanju, for statement wey e release on Monday, say INEC get constitutional responsibility to fully carry out the decision of the Supreme Court. According to am, the commission no suppose delay or choose which part of the judgment e wan implement.

He specifically called on INEC to remove from its official portal the names of candidates of political parties affected by the Supreme Court judgment. Adeyanju say this na one of the necessary steps wey the electoral commission need to take to properly give effect to the court decision.

The lawyer referred to Section 287(1) of the 1999 Constitution, wey requires all authorities and persons to give effect to decisions of the Supreme Court. Based on this provision, Adeyanju say INEC must make sure say the judgment dey reflected fully in the commission’s official records.

He further urged INEC to take all the necessary administrative steps to implement the court orders in full. He stressed that compliance with the judgment should not be selective or delayed, and say the commission should act without further delay.

The development follows the recent Supreme Court decision on some provisions of the Electoral Act 2026. A seven-member panel of the Supreme Court reportedly unanimously allowed INEC’s appeal and restored Sections 77(5), 77(7) and 84(2) of the Electoral Act.

The three sections had earlier been invalidated by the Court of Appeal. But following INEC’s appeal, the Supreme Court restored the provisions, bringing fresh attention to how the affected political parties and their candidates would be treated under the law.

Adeyanju is now asking INEC to ensure that the commission’s portal and other official records properly reflect the effect of the Supreme Court judgment, while carrying out every administrative action required by the court’s decision.
